Metropolitan Planning Organizations across the country are jointly funded by the Federal Highway Administration and the Federal Transit Administration, which are divisions of the United States Department of Transportation.

The most recent surface transportation authorization act is titled the Infrastructure Investment & Jobs Act (IIJA) and was enacted on Nov. 15, 2021 as Public Law 117-58. The IIJA authorizes the Federal surface transportation programs for highways, highway safety, and transit for the 5-year period 2022-2026.

Metropolitan transportation planning requirements are codified at the Federal level in 23 United States Code, Section 134. Further detailed requirements are also found in 23 Code of Federal Regulations (CFR), Part 450, Subpart C.

The management of the APO’s federal planning grants are governed by 2 CFR, especially part 200.

Title VI prohibits discrimination on the basis of race, color, or national origin in any program or activity that receives Federal funds or other Federal financial assistance. Programs that receive Federal funds cannot distinguish among individuals on the basis of race, color or national origin, either directly or indirectly, in the types, quantity, quality or timeliness of program services, aids or benefits that they provide or the manner in which they provide them.

Executive Order 13116 requires Federal agencies and recipients of Federal financial assistance to examine the services they provide, identify any need for services to those with limited English proficiency (LEP), and develop and implement a system to provide those services so LEP persons can have meaningful access to them.

Executive Order 12898 focuses federal attention on the environmental and human health effects of federal actions on minority and low-income populations with the goal of achieving environmental protection for all communities, which is also sometimes referred to as Environmental Justice (EJ).

As with any other government agency, the APO and its processes and procedures are subject to the requirements of the Americans with Disabilities Act of 1990.
